TERMS OF AGREEMENT

General: For the clients performance(s), CMC MUSIC FACTORY shall: (1) Provide a qualified Host, DJ system, and all additional equipment as specified above; (2) Transport and setup all equipment at the location(s) specified above; (3) Promptly remove all equipment at the conclusion of the performance(s). A CMC MUSIC FACTORY representative shall be solely responsible for the operation of all equipment during the performance(s).

Hosts: Each Host representing CMC MUSIC FACTORY has been accredited in accordance with CMC MUSIC FACTORY standards of talent and ability as a qualified DJ performance Host. However, the quality of entertainment is susceptible to widely varying degrees of satisfaction. Therefore, the client agrees that mere dissatisfaction with a Host’s performance or disappointment in the audience’s reception to the performance shall not support a claim for refund of any portion of the fee paid.

Copyright License: Copyright law requires that a license be obtained for any public DJ performance “at a place open to the public or at a place where a substantial number of persons outside the normal circle of a family and it’s social acquaintances is gathered.” The client warrants that the client has obtained the necessary copyright license for public performances pursuant to this Agreement and agrees to produce evidence of such licensee at CMC MUSIC FACTORY'S request. The client agrees to indemnify CMC MUSIC FACTORY for any liability, including reasonable attorney fees and costs, on any claim of copyright infringement arising out of public performances pursuant to this Agreement.
